Approving Regulations Governing the Supervision of Marine Scientific and Technological Research Conducted in the Maritime Zone under National Jurisdiction

CHAPTER I

SUPERVISION OF MARINE SCIENTIFIC AND/OR TECHNOLOGICAL RESEARCH CONDUCTED BY FOREIGN VESSELS OR ENTITIES

Article 1

Any foreign person, whether natural or juridical, either personally or duly represented, desiring to conduct marine scientific and/or technological research in the maritime zone under national jurisdiction extending up to 200 miles and including its waters, the airspace over it, its continental shelf, bed and subsoil, must submit an application not less than six months in advance of the starting date of the research. The application may be submitted to the Ministry of Foreign Affairs of Chile through the official foreign affairs body of the applicant country or the diplomatic mission of that country in Chile, or directly to the Navy Hydrographic and Oceanographic Service.

Article 2

The application must contain at least the following information, although other information may be requested according to the circumstances:

First and last names, address, occupation and nationality of the applicant.

If the application is made through a representative, it must be accompanied by a certificate or official document authorizing such representation.

Name of the institution sponsoring the research, and names of the persons representing it in Chile.

Characteristics of the vessel, with specific reference to any part of it which is to be used to conduct scientific and / or technological research.

An attached inventory of the technical equipment to be used in the research work.

Programs, objectives and types of scientific research to be conducted.

Number of Chilean scientist who, depending on the availability of the vessel, might participate, and how feasible it would be for them to conduct their own research work.

Length of stay of the vessel in the maritime zone of up to 200 miles under national jurisdiction, and schedules of Chilean ports of call; name of the national port from which it will launch its scientific activities.

Geographical area where the applicant wishes to operate, and indication of navigational course.

Geographical position of work stations.

First and last names, address, occupation or specialty, and nationality of the participants in the research.

Article 3

Applications submitted through the Ministry of Foreign Affairs shall be immediately forwarded by the Ministry to the Office of the Commander-in-Chief of the Navy, with a copy sent, for information, to the Navy Department, Ministry of National Defense.

The Office of the Commander-in-Chief of the Navy, if no comments on the application are deemed necessary, shall refer it to the Hydrographic and Oceanographic Service for its report.

Article 4

The Navy Hydrographic and Oceanographic Service shall study the information in the case, and shall transmit the respective report to the Office of the Commander-in-Chief of the Navy, indicating how many Chilean researchers are to participate in the research.

This Institute shall ensure that national experts are given a genuine role in the planning and execution of the programme and that the complete results of the research are made available to the Chilean authorities. It shall also take appropriate measures to ensure that, as far as possible, all or a significant part of the processing and analysis of the data and samples obtained during the research is carried out at a location in Chilean territory selected by it.

Article 5

With the benefit of the reports assembled, the Office of the Commander-in-Chief of the Navy shall resolve whether the application is to be granted, modified or rejected, communicating such resolution to the Navy Department, Ministry of National Defense, and to the Ministry of Foreign Affairs; all of the foregoing shall not affect the jurisdiction which the Office of the State Frontiers and Borders has over such matters, when the research in questions is to be carried out in the State's border regions.

Article 6

If the resolution of the Office of the Commander-in-Chief of the Navy states that the application must be modified, the applicant shall have a period of 30 days from the date of the notification to make the necessary changes.

Article 7

The maritime authority shall notify the Navy Hydrographic and Oceanographic Service, within 24 hours of the entry into a national port of any duly authorized foreign scientific vessel arriving to conduct research in the maritime zone of up to 200 miles under national jurisdiction, so that the staff of the Institute may carry out an inspection, with no restrictions whatever, or all the equipment and compartments of the scientific vessel, in order to verify the information provided in the application; all the expenses arising from this inspection, including fares, shipping costs, subsistence allowances, etc., shall be the responsibility of the applicant. This inspection may be repeated as many times as is deemed appropriate.

Article 8

The Navy Hydrographic and Oceanographic Service, having carried out the inspection provided for in the preceding article, shall issue a resolution indicating the marine scientific or technological nature of the foreign vessel and containing the corresponding instructions for supervision; such instructions shall be required by the maritime authorities before the vessel is authorized to weigh anchor, without prejudice to the requirement of compliance with any other legal rule or regulation.

Article 9

If a foreign scientific vessel planning to conduct research in the maritime zone under national jurisdiction puts into port without having complied with the provisions of these regulations, it shall not enjoy the benefits and rights granted by Chilean vessels to foreign scientific vessels, and it shall be understood for all legal purposes that such vessel does not have this Status, and therefore may not conduct research under any circumstances.

Article 10

If the applicant for research work wishes to extend the already authorized period, he must submit an application to the Navy Hydrographic and Oceanographic Service, at least 30 days before the date of expiry of such authorization, accompanied by a report on the work completed.

Article 11

Any material collected, filmed or recorded during the research authorized in accordance with these regulations, as well as any mineral or fossil material collected within the aforementioned limits, may be taken out of the country only with the prior authorization of the Navy Hydrographic and Oceanographic Service, which to that end may request appropriate advisory assistance from specialized bodies. In any case, the Hydrographic and Oceanographic Service may retain such articles, information or data relating to the research as it may deem appropriate.

Article 12

The foreign scientific vessel, before departing from the country, must deliver to the Navy Hydrographic and Oceanographic Service a copy of the data and results obtained from the research completed. It must also deliver any holo types it has collected, which are to be sent on to the National Museum of Natural History in accordance with the provisions of article 2 of Act No. 17,288.

Article 13

The foreign scientific vessel may depart from the country only be the ports of Valparaiso, Arica or Punta Arenas, having obtained prior authorization from the Navy Hydrographic and Oceanographic Service, which shall certify that the provisions of these regulations have been complied with. In very special cases, the Navy Hydrographic and Oceanographic Service may designate another port for the purpose of this provision.

The maritime authority may not authorize the sailing of the vessel until the provisions of the first paragraph of this article have been complied with, regardless of what is established by other prevailing legal provisions.

Article 14

The heads of scientific expeditions must send a detailed report on the work completed to the Navy Hydrographic and Oceanographic Service within a period of six moths from the vessel's departure from Chile.

CHAPTER II

SUPERVISION OF MARINE SICENTIFIC AND/OR TECHNOLOGICAL RESEARCH CONDUCTED BY NATIONAL VESSELS OR ENTITIES

Article 16

Any natural of juridical person of Chilean nationality desiring to conduct marine scientific and/or technological research in the maritime zone under national jurisdiction, including its waters, its continental shelf, the airspace over it, and its bed and subsoil, must submit directly to the Navy Hydrographic and Oceanographic Service its plan of work not less than three months in advance of the starting date of the research. The participation of aliens shall be possible only with the prior authorization of the Navy Hydrographic and Oceanographic Service, which may establish such rules as it may deem appropriate in the light of the circumstances. In any case, the rules established in articles 10 and 11 shall apply, as well as the provisions or article 12 with regard to holotypes.

Article 17

The Navy Hydrographic and Oceanographic Service may make suggestions as to a particular program, appoint staff to participate in the research, request free copies of studies being prepared or studies of special interest to it, and restrict or retain such articles, information and data as it may deem appropriate.

Article 18

The resolution issued by the Navy Hydrographic and Oceanographic Service, once the plan of work has been approved, shall contain instructions for supervision and may exclude research in areas which are considered restricted. This resolution shall be required by the maritime authority before the vessel is authorized to weigh anchor at the start of the research.

CHAPTER III

PENALTIES

Article 19

Any breach of these regulations shall be punished by the maritime authority, at the request of the Navy Hydrographic and Oceanographic Service, in accordance with article 342 of the General Regulations relating to Order, Safety and Discipline on the Vessels and along the Seaboard of the Republic; this does not preclude the confiscation of the articles and data obtained trough research and the suspension of the authorization to proceed with the research.

In addition to any other penalties to which it may be liable, the foregoing shall be applicable also to any foreign or national entity or vessel which is caught without an authorization to conduct marine scientific and/or technological activities in the maritime zone under national jurisdiction.

Supreme Decree (M) No. 272 of 20 March 1975 is hereby SUPERSEDED and declared null and void.

ADDITIONAL INSTRUCTIONS FOR COMPLIANCE WITH

SUPREME DECREE No. 711

Applications for authorization to conduct marine scientific and technological research must be submitted in a letter supplementing the information required in the form attached as annex I, which must be completed in full. Providing all the particulars will obviate the need to request further information or return the forms.

For the purposes of article 7 (Supreme Decree No. 711), if the vessel puts in at a port other than Valparaiso, the round-trip fare between that port and Valparaiso and $US 100 as subsistence allowance must be remitted with the application.

The resolution to be drawn up by the Hydrographic and Oceanographic Service after the inspection has been carried out in accordance with the provisions of article 8 (Supreme Decree No. 711) is attached as annex III).

During its stay in waters under Chilean jurisdiction, the vessel must report its position daily at 0800 and 2000 hours, local time, through the nearest navy radio station or another station which has been designated as its monitor or link-up station.

During the day and while it remains in waters under Chilean jurisdiction, the vessel shall fly its own national flag; it shall identify itself by light-signals and on 2,182 kHz and channel 16 upon sighting warships, aircraft and lighthouses, and must also fly the Chilean flag on the foremast.

If necessary, the vessel may request for the geographical areas in which it sails, special meteorological aid from the Navy Meteorological Service through the local maritime authority (Maritime Office).

For all communication and link-up purposes in any case where the vessel requires assistance, it must adhere to the guidelines given in annex II, attached.
